Agreement to Terms

By accessing or using FuturePostman, you agree to these Terms. If you do not agree, do not use the service.

Service Description

FuturePostman lets you compose letters (text and optional media) and schedule them for future delivery. Letters may also be published publicly if you choose. Delivery uses a configured SMTP provider; delivery times are best-effort and may be impacted by third parties or system maintenance.

Accounts

  • You must provide accurate information and keep your account secure.
  • Authentication is provided by Clerk; you are responsible for your credentials.
  • You must be at least 13 years old (or the minimum age in your jurisdiction).

Acceptable Use

  • No illegal, abusive, harassing, or infringing content.
  • No spam or unsolicited bulk messages.
  • No content that violates privacy or intellectual property rights.
  • No attempts to bypass security or disrupt the service.

We may moderate public letters and remove content or suspend accounts that violate these rules.

Public Letters

Publishing a letter makes its content visible to anyone. You are responsible for what you publish. We may remove public content that violates these Terms or applicable law.

AI Features

When you use AI compose, your prompt and relevant context may be sent to a third-party AI provider solely to generate the requested output. Do not include confidential information you are unwilling to share with the AI provider.

Anonymous Sending

Anonymous sending is a Pro+ feature that allows you to hide your identity from email recipients. This feature is intended solely for legitimate privacy purposes and must be used responsibly.

Prohibited Uses:
  • Harassment, threats, intimidation, or any form of abuse
  • Spam or unsolicited commercial messages
  • Illegal activities or content that violates applicable laws
  • Impersonation or fraudulent communications
  • Content that violates intellectual property rights
  • Any malicious, offensive, or inappropriate content
Enforcement:

We reserve the absolute right to permanently ban accounts that misuse anonymous sending. Violations may result in immediate account termination without prior warning or refund. All anonymous emails are logged for security and compliance purposes, and recipients can report abuse which will be investigated.

Payments & Subscriptions

Subscriptions are processed by Stripe. Plan features and pricing are shown at the time of purchase. Taxes may apply. Manage or cancel your subscription at any time from your account. If you believe you were charged in error, contact support.

Intellectual Property & User Content

Your Content: You retain ownership of content you create. By using the service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your content as needed to operate the service and deliver letters.

Public Letters: Content you publish publicly may be displayed, indexed, and cached by search engines and other services. You grant us additional rights to promote and showcase public content as part of the platform experience.

Content Responsibility: You are solely responsible for your content and represent that you own or have necessary rights to all content you submit. You warrant that your content does not infringe any third-party rights, violate laws, or contain malicious code.

Content Removal: We reserve the right to remove any content that violates these Terms, applicable laws, or poses security risks, without prior notice and at our sole discretion.

Export Compliance & International Use

You represent that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, and are not on any government prohibited or restricted party list. You agree to comply with all applicable export and import laws. We may restrict access from certain jurisdictions and reserve the right to suspend accounts for compliance reasons.

Service Level & Performance Disclaimers

No Service Level Agreement: We do not provide any service level agreements (SLAs) or uptime guarantees. Service availability may vary and maintenance windows may occur without advance notice.

Third-Party Dependencies: Our service relies on third-party providers (SMTP, cloud services, etc.). We are not responsible for third-party service failures that may affect message delivery or service availability.

Beta Features: Features marked as beta, experimental, or preview are provided as-is and may be unstable, incomplete, or discontinued without notice.

General Disclaimers

The service is provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law. We do not guarantee on-time delivery in all cases, uninterrupted operation, or error-free performance.

Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, loss of profits, data, or goodwill arising from your use of the service.

Service Disruption & Business Closure: We shall not be liable for any damages, losses, or expenses resulting from service interruption, discontinuation, bankruptcy, business closure, or inability to deliver scheduled messages due to circumstances beyond our reasonable control.

Maximum Liability: Our total liability to you for all claims relating to the service shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability, or $100 USD, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless FuturePostman, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) content you submit, post, or transmit through the service; (e) your use of anonymous sending features; or (f) any scheduled messages sent on your behalf.

Force Majeure

We are not responsible for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, government actions, network failures, third-party service outages, financial market disruptions, or bankruptcy proceedings. Such events may result in temporary or permanent service suspension without liability.

Service Availability & Discontinuation

FuturePostman is provided on an "as available" basis. We reserve the absolute right to discontinue, suspend, or terminate the service at any time, for any reason, including but not limited to:

  • Financial difficulties, bankruptcy, insolvency, or business closure
  • Legal, regulatory, or compliance requirements
  • Technical limitations, security concerns, or infrastructure issues
  • Changes in business strategy or market conditions
  • Inability to maintain viable operations
  • Any circumstances beyond our reasonable control
Important Notice:

In the event of service discontinuation, we will make reasonable efforts to provide advance notice where feasible (minimum 30 days when possible), but circumstances may require immediate cessation without prior notice. No refunds will be provided for unused subscription periods in case of service discontinuation due to bankruptcy, insolvency, or circumstances beyond our control.

Data Recovery During Shutdown: We may provide a limited-time opportunity to export your data before final service termination, but this is not guaranteed and depends on available resources and technical feasibility. You are responsible for regularly backing up any important content.

Account Termination

We may suspend or terminate your access if you violate these Terms or for risks to the service or other users. You may stop using the service at any time. Account deletion is available in Settings. We are not liable for any consequences of account termination, including loss of scheduled messages or associated data.

Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal dispute, you agree to contact us at support@futurepostman.com to seek an informal resolution.

Binding Arbitration: Any dispute arising from these Terms or your use of the service will be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court. Arbitration will be conducted by a single arbitrator under the rules of a recognized arbitration organization.

Class Action Waiver: You agree that disputes will be resolved individually and you waive any right to participate in class action lawsuits or class-wide arbitration.

Assignment & Business Transfers

We may assign these Terms and transfer our rights and obligations (including user accounts and data) to any third party in connection with a merger, acquisition, reorganization, sale of assets, or bankruptcy. You may not assign your rights under these Terms without our written consent.

Severability & Entire Agreement

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the service and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of [YOUR_JURISDICTION], without regard to conflict of law principles. Any legal action or proceeding relating to your access to or use of the service shall be instituted in the courts of [YOUR_JURISDICTION], and you agree to submit to the jurisdiction of such courts.

Changes

We may update these Terms. If changes are material, we will provide reasonable notice (e.g., in-app or via email). Continued use after changes becomes effective constitutes acceptance.
